These SMS Terms of Use (the “SMS Terms of Use”) govern the provision and delivery of text messages by Aurora Energy (“Aurora Energy,” “we,” “us,” or “our”) and our text message service providers.
1. Acceptance
1.1 By subscribing to or otherwise agreeing to receive text messages from or on behalf of Aurora Energy ( “SMS Service”), or by otherwise providing your phone number to Aurora Energy, you agree to these SMS Terms of Use. These SMS Terms of Use are in addition to Aurora Energy’s Privacy Statement and Website Terms of Use.
2. Opt in
2.1 By opting into any SMS Service, you expressly consent to receive transactional, operational or informational text messages that may be sent using an automatic telephone dialling system, by or on behalf of Aurora Energy, to the cell phone number you provide us. The number and frequency of text messages that you receive will vary depending on which Aurora Energy SMS Service you sign up for.
2.2 We may not be able to deliver the SMS Service to all mobile carriers. Aurora Energy and all mobile carriers are not liable for any delayed or undelivered messages sent via the SMS Service.
3. Opt out
3.1 You may opt out of any SMS Service at any time by replying “STOP” to the number sending the text message, contacting Aurora Energy customer service at 0800 22 00 05 or via our website www.auroraenergy.co.nz
3.2 After opting out of a particular SMS Service, you may receive additional communications confirming that your request has been received and processed. You may continue to receive text messages for a brief period while we process your request.
3.3 If you opt out of one SMS Service, you will remain opted into all other Aurora Energy SMS Services (if applicable) unless you opt out of those SMS Services individually. 3.4 You can re-subscribe to any Aurora Energy SMS Service by following the relevant instructions for that service.
4. Message and data rates
4.1 Aurora Energy does not charge for the SMS Service. However, standard message and data rates may apply for any messages sent to you from or on behalf of Aurora Energy and any messages you send to us. If you have any questions about your text plan or data plan, contact your mobile service provider.
5. Eligibility and change in phone number
5.1 By providing your cell phone number to Aurora Energy, you confirm that you are at least 18 years old and that you are either the current subscriber or authorised user of that phone number. If you change, forfeit, or deactivate the phone number you have provided to Aurora Energy, you agree to notify Aurora Energy immediately.
6. Authority to subscribe to power outage SMS service
6.1 By providing your cell phone number to Aurora Energy for the power outages SMS Service, you confirm that you are authorised to receive information on behalf of the registered installation control point number for the property.
6.2 You acknowledge and accept that the SMS Services are not guaranteed and may be affected by factors beyond our control, including cell phone network or mobile carrier issues.
6.3 By subscribing to the planned power outages SMS Service, you also consent to receiving any future SMS Services from Aurora Energy notifying you about any unplanned power outages, or any critical situations/events.
7. Conditions of power outage SMS Service
7.1 By opting into Aurora Energy’s power outage SMS Service, you accept that text message reminders about planned power outages will be sent during business hours, seven days a week.
7.2 You further accept, if a SMS Service is introduced for unplanned outages, text messages may be sent at any time, including overnight. You are responsible for managing your device settings (for example, using the ‘Do Not Disturb’ setting on your phone) if you prefer not to receive messages during certain hours.
8. Liability
8.1 Aurora Energy’s SMS Service is a reminder for information purposes only. In no event will Aurora Energy be liable to you or any third party for any losses or damages arising from your use of or reliance on content either provided by or omitted from the SMS Service.
8.2 SMS Services are not a substitute for emergency notifications or direct contact with your electricity retailer.
9. Aurora Energy Privacy Statement
9.1 Aurora Energy values your privacy and has policies in place to ensure personal information remains confidential.
9.2 Your personal information will be handled in accordance with our Privacy Statement. By subscribing to any SMS Service, you are deemed to have read and agreed to our Privacy Statement.
9.3 You understand that the information you provide when signing up for the SMS Service will be securely stored by Aurora Energy and used solely to send updates about power outages, or critical situations/events.
9.4 You understand and agree that while Aurora Energy will use commercially acceptable means to protect your personal information, we cannot guarantee its absolute security.
10. General
10.1 Aurora Energy may update these SMS Terms of Use, our Privacy Statement, or our Website Terms of Use from time to time. By continuing to use the SMS Service after any such changes, you will be deemed to have accepted the updated SMS Terms of Use, Privacy Statement and Website Terms of Use.
